What Is an Enduring Power of Attorney?
An Enduring Power of Attorney is a legal document under the Enduring Powers of Attorney Ordinance (Cap.501), allowing a mentally capable individual (the donor) to appoint a trusted person (the attorney) to handle property, banking, and financial affairs. Unlike a general power of attorney, an EPOA remains valid even after the donor loses mental capacity.

Who Can Be Appointed as Attorney?

Legal Requirements & Registration
- The donor must sign the EPOA before a solicitor and a registered medical practitioner.
- Both must certify that the donor fully understands the nature and effect of the EPOA.
- The EPOA must be registered with the High Court Registrar (Registration of Enduring Powers of Attorney) for it to take effect after incapacity.
- The donor can revoke the EPOA at any time while mentally capable.
