Steps in the Legal Repossession Process

  1. Issuance of Eviction Notice: The Bailiff, accompanied by the landlord, serves the “Eviction Notice” to the occupant, notifying them to vacate the premises within 7 days. If the door is locked, the notice is posted at the entrance.
  2. Follow-Up Inspection: After 7 days, the Bailiff conducts a follow-up inspection. If the premises are vacated, possession is immediately returned to the landlord. If still occupied, a notice specifying the date of repossession is issued.
  3. Execution of Repossession: The Bailiff and locksmith may lawfully enter the property and create an inventory of items, with photographs for evidence (photo fee: HK$40 per image). The landlord must arrange for removal and safekeeping of tenant belongings and return them upon request.

Executing a Possession Order and a Distress for Rent Order Simultaneously

If a landlord is entitled to recover possession and claim unpaid rent, both a “Possession Order” and a “Distress for Rent Order” can be executed together. In such cases, the Bailiff will assign a security officer to guard the premises, and after the assets are sealed for at least 8 days, they can be lawfully auctioned. This procedure ensures full legal compliance and protection for all parties.
